1. Purpose

These Terms and Conditions of Sale (hereinafter the “T&Cs”) define the conditions applicable to any order placed on the Pilatix website.

Any order placed on the website implies full and unconditional acceptance of these T&Cs by the customer.

These terms govern the sale of products offered by Pilatix to both private and professional customers.

The customer is responsible for ensuring that the product meets their needs before placing an order.

4. Product Availability

Products are offered while stocks last or subject to manufacturing and supply capacity.

If a product becomes unavailable after order confirmation, the customer will be informed as soon as possible.

Depending on the situation, Pilatix may offer:

  • A replacement with an equivalent product
  • A delivery delay
  • A full refund of the order

5. Pricing

Prices displayed on the website are stated in euros (€).

VAT not applicable – Article 293 B of the French General Tax Code, unless otherwise stated.

Applicable delivery fees are shown before final order confirmation.

Pilatix reserves the right to modify prices at any time. However, the price charged is the one displayed at the time of order confirmation.

6. Payment

Payment is due immediately upon order validation.

Accepted payment methods are those available at checkout on the website.

Payments are processed securely via third-party payment providers.

Pilatix does not store any banking information.

In the event of payment refusal, failure, or suspected fraud, the order may be suspended or cancelled.

7. Orders

An order becomes final once:

Pilatix reserves the right to refuse or cancel any order, particularly in cases of:

  • Suspected fraud
  • Abusive use of services
  • Clearly incorrect or incomplete information

8. Delivery

Delivery times are provided as estimates and may vary depending on:

  • Manufacturing constraints
  • Logistics and transport conditions
  • Customer location

Pilatix cannot be held responsible for delays caused by carriers or events beyond its control.

For bulky equipment, particularly Pilates Reformers, specific transport, installation, or delivery arrangements may apply.

9. Right of Withdrawal

In accordance with Articles L221-18 and following of the French Consumer Code, customers have a 14-calendar-day period from receipt of the order to exercise their right of withdrawal without providing justification.

The customer must include:

  • Order number
  • Product concerned
  • Withdrawal request

Returned products must be:

  • Unused
  • Unassembled
  • In perfect condition
  • Returned in their original packaging or equivalent protection

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to customer specifications or clearly personalized.

10. Returns and Refunds

Full return and refund terms are detailed in the Return and Refund Policy available on the website.

Returns must be pre-approved by customer service before shipment.

In the case of a defective, damaged, or non-compliant product, Pilatix covers return shipping costs after review and validation of the case.

The customer may be asked to provide supporting evidence (photos or videos) before approval.

11. Warranties

Commercial Warranty

Some products may benefit from a specific commercial warranty, as stated on product pages or dedicated sections of the website.

Unless otherwise specified:

  • Pilates Reformer frames: 5-year commercial warranty
  • Accessories and complementary equipment: 1-year commercial warranty

The commercial warranty covers only manufacturing or material defects under normal use.

Exclusions include:

  • Normal wear and tear
  • Improper use
  • Non-compliance with instructions
  • Poor maintenance
  • Unauthorized repairs or modifications
  • Damage due to transport or improper storage after delivery

Legal Warranties

Customers also benefit from legal warranties under applicable law:

  • Legal warranty of conformity (Articles L217-3 and following of the French Consumer Code)
  • Warranty against hidden defects (Articles 1641 and following of the French Civil Code)

12. Liability

Pilatix makes every effort to ensure the accuracy of information and proper execution of orders.

However, it cannot be held responsible for:

  • Improper product use
  • Incorrect installation
  • Improper assembly by the customer or a third party
  • Misuse or non-compliant use
  • Indirect or consequential damages
  • Events beyond its control

The customer remains solely responsible for product use after delivery.

For professional or bulky equipment, especially Pilates Reformers, the customer must ensure compatibility of dimensions, access conditions, and installation constraints before ordering.

13. Retention of Title

Products remain the exclusive property of Pilatix until full payment of the order, including all fees and taxes.

However, risk is transferred to the customer upon receipt of the product.

14. Force Majeure

Pilatix shall not be held liable for failure or delay in performance due to force majeure under French law.

This includes, but is not limited to:

  • Natural disasters
  • Fire
  • Strikes
  • Major transport disruptions
  • Supply shortages
  • Health crises
  • Government or administrative decisions
  • Cyberattacks or IT failures beyond its control

Performance of obligations may be suspended for the duration of the event.

15. Intellectual Property

All website content, including:

  • Texts
  • Photographs
  • Videos
  • Logos
  • Graphics
  • Visuals
  • Designs
  • Trademarks and marketing content

is protected under intellectual property laws.

Any reproduction, distribution, adaptation, or use without prior written authorization is strictly prohibited.
